2008 CONTRACT FOR SHIPPED COOLED SEMEN
______________________________________ (mare owner) hereby agrees with Black Horse Ranch (BHR) for the mare known as ____________________________________ Breed ______________ Registration # ______________ Age __________ (MAIDEN/ BARREN / FOALING DATE ______________________) to receive semen from the stallion _________________________________________ for the mare as follows:
1. BHR agrees to provide semen to the owner of the above named mare for the sole purpose of impregnating that mare.
2. The fee to be paid to BHR upon signing of the contract (booking fee, non refundable) is __________and prior to first shipment of shipped semen balance due is $_______ . Original signed contract must be delivered to BHR prior to shipment. Stud fee may be made by MasterCard or VISA or certified check. A deposit of $200.00 will be needed for use of the shipping container, which can be made by credit card. A refund to the card will be made upon delivery back to BHR of the container. Containers are due back within 48 hours of delivery to the mare owner, or a agreed upon container rental rate of $50.00 per day will be billed. Freight and shipping charges are the sole responsibility of the mare owner. We prefer to ship Federal Express and a credit card authorization is required, unless a valid Federal Express account is given. Disposable containers are available, call for prices. You may also supply your own Equitainer for shipment to you.
3. The owner represents that the mare will be in healthy and sound breeding condition at the time of artificial insemination. BHR guarantees a live foal from the semen contracted for here, subject to the provisions of paragraph five (5). A live foal is one that stands and nurses without assistance. If the foal fails to stand an nurse, the mare owner will be entitled to return priviledges the following breeding season. The breeding fee is non-refundable and all charges for shipments, and collection fees will be paid by mare owner.
4. BHR will provide up to two (2) shipments of semen of necessary to impregnate the mare named in this contract. The container deposit and shipping charges shall always be paid by the mare owner. A veterinarian’s certificate that the mare is not pregnant or has lost her foal is required prior to the third shipment, or prior to bringing the mare to BHR to be bred the remainder of the breeding season as provided in paragraph five (5), stating unequivocally that the mare was not impregnated or that she lost her foal, and that the artificial insemination procedures were carried out in accordance with commonly accepted medical standards.
5. If the mare does not conceive after two (2) shipments, then the mare owner shall have the option to bring the mare to BHR to be bred the remainder of the breeding season, or of purchasing additional shipments at a cost of $150.00 (One hundred fifty dollars) to cover semen preparation and collection costs. If the mare does not produce a live foal from the 2006 breeding season, the following year the mare owner has the option to either continue receiving shipped semen at a cost of $150.00 (one hundred fifty dollars) per shipment plus shipping charges and container deposits, or bring the mare to BHR. At all times that the mare is at BHR, the mare owner agrees to pay BHR its customary charges for pasturing, feeding, board, and veterinary expenses incurred as provided in BHR’s Stallion Service Contract. If the mare does not produce a live foal after the second year, the mare owner shall have no further rights under this contract.
6. The owner represents that it will employ, for purposes of insemination, a qualified and experienced veterinarian in horse insemination.
7. BHR represents that the semen shipped to the owner is from the stallion named in this contract and is of sufficient motility and morphology to accomplish pregnancy.
8. This contract is not transferable or assignable.
9. This contract shall be construed and governed by the laws of the State of Nevada. In the event it becomes necessary for either parties to this contract to file a suit arising from this contract, the same must be filed and maintained in the Circuit Court of Douglas County, Nevada. If any legal action is used to enforce the terms of this contract, the prevailing party shall be entitled to receive from the losing party his reasonable attorney’s fees, cost of discovery, travel costs and expenses of suit.
10. The owner shall sign and return one copy of this contract to BHR before it is binding on the parties.
11. Semen shall be shipped by BHR as soon as practical after notification is received from the mare owner.
12. BHR owned Equitainers require a $200 (two hundred dollar) deposit for use. If payment made by credit card, the deposit will be fully refunded upon return to BHR within 48 hours of mare owner receipt. All ApHC Shipped Semen required paperwork MUST be returned with container.

SHIPPED SEMEN: Cooled semen shipping days are Monday, Wednesday and Friday. Notify us 24 hours prior to shipment or by 9AM the day of shipping to confirm. If you require semen on Sunday, call on Friday before 9AM to make arrangements. Airport courier fee (or bus depot drop off if within 300 miles) is $75.00. Requests for shipped semen will be filled subject to availability of semen. Stallion owner will determine which orders are filled based on information supplied by attending veterinarian, if there is insuffiecient semen to fill all orders. All shipping charges are to be paid by the mare owner.
